Overview

Deepa Ramjee is a local partner in the commercial litigation practice of White & Case in Johannesburg.

Deepa's litigation practice focuses on technology-related disputes, financial services regulation, administrative law, construction, environmental law and business rescue and insolvency. She has represented clients in high court litigation and in both domestic and cross-border commercial arbitrations.

In addition to her litigation practice, Deepa  also regularly provides regulatory advice to clients in the information technology, telecommunications, payments and pharmaceuticals and healthcare sectors. This part of her practice covers significant cross-border and local work for multinational technology and a growing number of healthcare service providers. Deepa routinely advises on corporate compliance, data protection, artificial intelligence, e-commerce, online advertising, content regulation, cloud computing, financial services regulation, licensing and distribution agreements, medical device regulations and public procurement laws.

Contentious matters*

Representing a multinational steel-based technology and capital goods company in a review application against a South African parastatal and various other related parties in respect of a tender worth over ZAR 1 billion.

Representing a European company providing technology solutions to the banking and finance sector in a cross-border dispute relating to applications development and maintenance.

Representing a parastatal responsible for financing and implementing bulk raw water infrastructure projects, in review proceedings relating to the award of a tender for the construction of a bulk steel water pipeline with a tender value of ZAR 2,2 billion.

Representing a leading South African construction company in the review of an award for a ZAR 370 million housing development by the Department of Human Settlements.

Representing the South African Reserve Bank and the Registrar of Banks in relation to the interpretation and implementation of the various provisions of the Banks Act, 1990.

Representing a South African listed company in review application proceedings against a South African parastatal in respect of a tender involving, inter alia, the supply, transportation, delivery and installation of scaffolding for the thermal insulation of fifteen coal-fired power stations.

Representing a global technology services company in a contractual licensing dispute against a South African parastatal responsible for the generation, transmission and distribution of electricity.

Represented a leading South African construction company against the Lesotho Millennium Development Agency for in both cross-border arbitration and litigation regarding, inter alia, the interpretation of a FIDIC contract and insolvency laws.

Regulatory advisory matters*

Advising various multinational technology clients providing internet-related services, products, and media content in South Africa on the regulation of personal information, in addition to formulating policy submissions on impending legislation, regulations and guidelines regulating the processing of personal information.

Advising clients in the financial services, communications, and retail industries on the impacts of the GDPR, preparing readiness assessments and the drafting of various data protection clauses for both data controller and data processor activities.

Representing a multinational virtual network operator in negotiating and concluding a major call center and network servicing outsourcing agreement.

Advising multinational technology clients on the regulation of online platforms, online service providers, content regulation, intermediary liability, e-commerce, sales and marketing, copyright, interception of communications and data privacy.

Advising multinational technology clients, including financial service providers, providing internet-related services and products on payment regulations focussing on the regulation of third-party payment providers and system operators, the balance of payments and exchange control.

Advising international clients in the healthcare and pharmaceuticals industries relating to the regulation of (novel) medical devices, artificial intelligence and data protection, advertising and marketing, incentive schemes, public healthcare insurance and public sector contracts.
